Anti-Spam Policy
1. Definitions
- Commercial Electronic Message (CEM): Any electronic message (e.g., email, text) that encourages participation in a commercial activity, including promotions, offers, or advertisements.
- Spam: Unsolicited CEMs, including bulk emails sent without valid consent, messages with false or misleading headers, or those that violate CASL or other anti-spam laws.
- Consent: Express consent (explicit agreement) or implied consent (e.g., based on an existing business relationship) as defined under CASL.
- Hosted Email Services: Our email hosting solutions, including mailboxes, forwarding, and any tools for sending or receiving emails through easyDNS servers.
2. Prohibited Activities
You must not use our Hosted Email Services to:
- Send, facilitate, or encourage the sending of spam or unsolicited CEMs.
- Transmit emails without obtaining and documenting valid consent from recipients, as required by CASL.
- Use false, misleading, or deceptive subject lines, headers, or sender information (e.g., spoofing).
- Harvest email addresses without permission or purchase/rent email lists from third parties unless the lists are CASL-compliant and recipients have consented to receive messages from you.
- Send CEMs that do not include:
- A clear and functioning unsubscribe mechanism (e.g., a link that processes opt-outs within 10 business days).
- Your valid physical mailing address and contact information.
- Identification of the sender (e.g., your business name).
- Engage in phishing, malware distribution, or any fraudulent activities via email.
- Bypass or disable our anti-spam filters or security measures.
- Use our services for high-volume bulk emailing that exceeds reasonable limits (as determined by us) without prior approval.
These prohibitions apply regardless of your location or the recipients' locations, as CASL has extraterritorial reach for messages sent from or accessed in Canada.
3. Your Obligations Under CASL
To ensure compliance:
- Obtain Consent: Before sending CEMs, you must have express or implied consent from each recipient. Express consent requires clear, affirmative action (e.g., checking a box) and must be documented (e.g., records of opt-ins). Implied consent may apply in limited cases, such as existing customer relationships within 2 years of a purchase or 6 months of an inquiry.
- Unsubscribe Compliance: All CEMs must include an unsubscribe option that is easy to use, free, and honored promptly (within 10 business days). You must not require login or additional steps beyond confirming the opt-out.
- Record-Keeping: Maintain records of consents, unsubscribe requests, and related communications for at least 3 years (as recommended under CASL enforcement guidelines).
- Content Accuracy: Ensure all CEMs accurately represent your identity, purpose, and content.
- Third-Party Lists: If using purchased or shared lists, verify they are obtained with valid consent and that recipients have not opted out.
- CASL Exemptions: Be aware that certain messages (e.g., transactional emails like order confirmations) may be exempt from consent requirements but must still comply with identification rules.

4. Our Anti-Spam Measures To protect our users and network:
- Filtering and Monitoring: We employ automated filters (e.g., spam detection tools) to monitor outbound and inbound emails. Suspicious activity may trigger reviews, blocks, or quarantines.
- Rate Limiting: We may impose sending limits on accounts to prevent abuse (e.g., daily or hourly caps on outbound emails).
- Reporting and Cooperation: We report confirmed spam or CASL violations to authorities (e.g., CRTC Spam Reporting Centre) and cooperate with investigations. We may share your information with law enforcement if required.
- Blacklist Monitoring: If your domain or IP is blacklisted due to spam complaints, we may suspend services until resolved.

5. Consequences of Violations
If we determine (in our sole discretion) that you have violated this Policy or CASL:
- We may issue warnings, suspend email sending capabilities, or quarantine your account.
- Repeated or severe violations may lead to full account suspension or termination, without refund.
- You may be liable for any fines, penalties, or damages we incur due to your actions (e.g., CRTC fines up to $10 million for corporations).
- We may apply "guilt-by-association" and terminate related accounts or domains sharing common identifiers.
- Violations could result in legal action against you under CASL or other laws.
We investigate complaints promptly and fairly, but our decisions are final.
6. Reporting Spam
- If you receive spam through our services, report it to abuse@easydns.com with full headers and details.
- For outbound spam from our users, we will investigate and take appropriate action.
7. Changes to This Policy
We may update this Policy to reflect legal changes or improvements. We will notify you via email or our website. Continued use of our services constitutes acceptance of updates.
8. Governing Law
This Policy is governed by the laws of the Province of Ontario and the federal laws of Canada, including CASL.
