A trial date has been set in the matter of Andy Lehrer vs easyDNS. Recall, this is the case where we were presented with a takedown request for some pages on causepimps.ca. We responded that “we don’t do that unless you have a legal basis, like a court order”, and then he went and sued both our customer and us.
Unless we get dropped (or have a judge strike us from) the suit before then, looks like we’re going to trial on March 30th, 2015 at 10:02am. Bring popcorn.
PDF of Lawsuit Deleted From Scribd
Also, we noticed when we looked back at the Update on Andy Lehrer vs easyDNS post that the PDF of the lawsuit hosted on Scribd had been deleted. Scribd support confirmed to us that it had been removed in response to a complaint filed earlier this week (but like many abuse desks, their policies prohibit them from telling us who complained). We have rectified the basis for the takedown and re-uploaded the PDF of the lawsuit. We have also placed a copy of it on our own servers in case something, you know, happens to the new version on Scribd.
UPDATE: Scribd deleted the document because Mr. Lehrer complained that his signature was unredacted. Mr. Lehrer says he just wanted the signature redacted, not the entire document taken down. The updated document has that. That the signature was unredacted in our original post was an oversight which we corrected as soon as we became aware. Sorry about that. (However, that said, it is a public document and can be obtained in unredacted form by anybody).

Thank you for your apology. I just wish to clarify one thing. You state "Mr. Lehrer says he just wanted the signature redacted, not the entire document taken down" – just to be clear this does not mean I approve of or am consenting to you putting the document up. While yes, the document is a public document by choosing to publish it you are furthering the libels I am suing over after having been put on notice of the defamation and so you are acting irresponsibly.

Mr Lehrer, with all due respect – this is a public document. YOU wrote the document, so don't complain to us about what's in it. The moment you chose to drag us into this lawsuit, you opened the door to disclosure.
We have a lawyer (not the one handling this case) who is fond of saying "you can't suck and blow at the same time". In other words, you can't have it both ways, you can't frivolously sue people and then expect them to adhere to your imagined norms of modicum or your incorrect interpretation of the law.

Well put – I don't think Mr. Lehrer is a fan of give and take. If someone wants to bring dirty laundry into the public eye, they shouldn't be afraid to show their stains.
EasyDNS and Scribd have already behaved well above the call of duty in this instance and I applaud both teams. EasyDNS is a phenomenal company, with great product and service to match – you're picking the wrong battles Mr. Lehrer.
